Partner Rental Agreement
This Rental Agreement is between the Lessor (Owner) and Lessee (Customer) for the rental of toy horses and other partner-supplied rental items booked through Party Witch. By placing a booking, the Lessee confirms that they have read, understood, and accepted these terms.
1. Rental Items
The Lessor agrees to rent the items, quantities, and prices shown in the booking confirmation to the Lessee. The rental fee, discounts, and total are confirmed during checkout.
2. Rental Period
The rental starts at the pickup or handover time shown in the booking. The return deadline is automatically set to 24 hours after the pickup time. All items must be returned by that deadline unless otherwise agreed in writing.
3. Security Deposit
The Lessee agrees to pay a security deposit of $300 CAD. The deposit will be refunded upon return of all rental items in acceptable condition. The Lessor reserves the right to deduct repair, cleaning, late-return, loss, or replacement fees as outlined below.
4. Proper Use and Responsibility
The Lessee agrees to use the rental items safely and properly, supervise children at all times, and avoid exposing toy horses or other items to paint, food colouring, mud, water damage, or rough surfaces.
5. Damage and Cleaning Fees
5.1 Surface Damage
If a toy horse shows serious wear, discoloration, or staining, including paint, food, mud, markers, or other substances, that cannot reasonably be cleaned or restored, the Lessee will pay $100 CAD per horse.
5.2 Functional Damage
If a toy horse is damaged in a way that affects normal use, structure, or safety, the Lessee will pay a $300 CAD replacement fee per horse. Reasonable repair or replacement charges may apply to other rental items.
6. Late Return Policy
If the Lessee fails to return the rental items by the 24-hour return deadline, an additional one-day rental fee will be charged for each extra day. Continued failure to return items may result in full replacement charges.
7. Loss or Theft
If any toy horse is lost, stolen, or not returned, a replacement fee of $300 CAD per horse will apply. Other missing rental items or parts may be charged at their reasonable replacement cost.
8. Photo Inspection and Condition Verification
Before handover, both parties agree that photos or videos of the Lessee and all rental items may be taken to document their condition. These images will serve as official evidence of the condition at the start of the rental.
Upon return, the items will be inspected and photographed again. Any damage or condition changes will be determined by comparison with the original photos. Digital photos, videos, or messages exchanged via text, email, or messaging apps, including Facebook or SMS, are valid documentation.
9. Dispute Resolution
Both parties agree to communicate in good faith to resolve any dispute. Photo documentation and written communication records will be used as primary evidence for determining responsibility. This agreement is governed by the laws of British Columbia, Canada.
10. Liability
The Lessee assumes full responsibility for safe use of the rental items. The Lessor shall not be liable for any injuries, accidents, or damages arising from use or misuse, except to the extent liability cannot legally be excluded.
11. Agreement Acceptance
By checking the acceptance box during checkout or otherwise confirming the booking, the Lessee agrees to all terms and conditions stated in this agreement. The parties may sign below or confirm acceptance electronically.
